Terms and Conditions

These Terms and Conditions govern purchases and use of services provided by The Lynchpin LLC, doing business as Lynchpin Training (“Lynchpin Training,” “we,” “us,” or “our”), through lynchpinfit.com and at our studio.

By placing an order, scheduling an appointment, or participating in a service, you agree to these Terms and Conditions, our Refund and Cancellation Policy, Privacy Policy, and any applicable participant waiver, informed-consent document, PAR-Q form, or client services agreement.
Services
Lynchpin Training offers services that may include:
- Comprehensive fitness evaluations;
- Private personal-training sessions;
- Group workouts;
- Strength, mobility, fat-loss, and conditioning programs;
- Rehabilitation-focused and return-to-function exercise;
- Program-design services; and
- Other fitness and wellness services described on our website.
Specific services, schedules, instructors, availability, and prices may change prospectively.
Evaluation Requirement
New clients may be required to complete a comprehensive fitness evaluation before participating in private training or certain other services.
The evaluation helps identify goals, limitations, movement considerations, and appropriate programming. It is not medical treatment and does not establish a physician-patient, physical therapist-patient, or other licensed healthcare-provider relationship.
Health and Medical Responsibility
Physical activity carries inherent risks. Before participating, clients must disclose relevant medical conditions, injuries, limitations, medications, pregnancy, or physician-imposed restrictions.
Clients may be required to complete a PAR-Q, health questionnaire, informed-consent form, and liability waiver before participating.
Clients should consult an appropriate licensed healthcare professional before beginning an exercise program when they have health concerns or have been advised to obtain medical clearance.
Lynchpin Training does not diagnose, treat, or cure medical conditions and does not replace care from a physician, physical therapist, registered dietitian, mental-health professional, or other licensed provider.
A client must stop exercising and notify the trainer immediately if pain, dizziness, shortness of breath, faintness, chest discomfort, or another concerning symptom occurs.
Appointments
Appointments are subject to availability and are not guaranteed until confirmed.
Clients are responsible for arriving on time. A late arrival may shorten the session so subsequent appointments can begin as scheduled. The session may still end at its originally scheduled time and may be charged in full.
Clients must provide at least 24 hours’ notice to cancel or reschedule an appointment. Late cancellations and missed appointments may be counted as used sessions, subject to applicable law and the Refund and Cancellation Policy.
Session Packages
Unless otherwise stated in writing:
- Packages may only be used by the named client;
- Packages cannot be sold, shared, or transferred;
- Each completed, missed, or late-cancelled appointment may deduct one applicable session;
- Packages expire 12 months after purchase;
- Scheduling remains subject to availability; and
- Purchasing a package does not guarantee a particular recurring appointment time.
Promotional discounts apply only as described in the applicable offer and generally cannot be combined.
Group Workouts
Group workouts have limited capacity. A reservation is required unless Lynchpin Training states otherwise.
Participants must follow the trainer’s instructions and respect other clients, staff, equipment, and the studio. Lynchpin Training may remove a participant whose conduct is unsafe, threatening, disruptive, discriminatory, or materially interferes with others.
Payments
All listed prices are in U.S. dollars unless stated otherwise. Payment is due at checkout or according to an approved written payment arrangement.
The client authorizes Lynchpin Training and its payment providers to charge the selected payment method for the purchased services, applicable taxes, and any clearly disclosed recurring charges.
Lynchpin Training may correct genuine pricing or clerical errors. If an error affects an order, the client will be offered the choice of paying the corrected price or cancelling the affected purchase for a refund.
Recurring Services
If a client purchases a recurring service or subscription, the price and billing frequency will be disclosed before checkout.
The client authorizes recurring charges until the subscription is cancelled in accordance with the terms presented at purchase and applicable law. Cancellation stops future renewals but does not ordinarily create a refund for a billing period already started, except when required by law.
Any automatic-renewal program will be administered in accordance with applicable California and federal law.
Refunds and Cancellations
Refunds, package cancellations, late cancellations, missed appointments, medical circumstances, and studio cancellations are governed by the Refund and Cancellation Policy.
Nothing in these Terms waives a client’s nonwaivable rights under California or federal law.
California Health-Studio Rights
If a purchase qualifies as a health studio services contract under California law, the client is entitled to all applicable statutory notices, cancellation periods, and refund protections.
Any separate written client services agreement provided by Lynchpin Training is incorporated into these Terms. If these website Terms conflict with a mandatory legal requirement or a client’s written services agreement, the legally controlling provision will apply.
Minors
A parent or legal guardian must purchase services for a minor, approve the minor’s participation, and sign all required agreements.
The parent or guardian is responsible for providing accurate health information and ensuring the minor follows studio and safety rules.
Client Conduct
Clients must:
- Provide complete and accurate account, billing, and health information;
- Follow reasonable safety instructions;
- Use equipment only as directed;
- Wear appropriate clothing and footwear;
- Respect staff, other clients, and studio property; and
- Avoid attending while impaired by alcohol, illegal drugs, or any substance that makes participation unsafe.
Lynchpin Training may suspend or terminate services for dangerous conduct, harassment, threats, fraud, repeated nonpayment, or material violation of these Terms. Any refund following termination will be determined under applicable law and the Refund and Cancellation Policy.
Results
Fitness results vary according to health, attendance, effort, nutrition, sleep, genetics, adherence, and other individual factors.
Lynchpin Training does not guarantee a particular amount of weight loss, muscle gain, pain reduction, functional improvement, athletic performance, or other outcome.
Website and Account Use
Clients are responsible for safeguarding their login credentials and promptly reporting suspected unauthorized access.
Clients may not interfere with the website, attempt unauthorized access, submit fraudulent orders, copy protected content without permission, or use the website unlawfully.
Intellectual Property
The Lynchpin Training name, branding, website content, written programs, videos, photographs, graphics, and training materials are owned by or licensed to Lynchpin Training and are protected by applicable intellectual-property laws.
Materials purchased or provided to a client are for that client’s personal, noncommercial use and may not be reproduced, sold, published, or distributed without written permission.
Privacy
Personal information is handled according to the Lynchpin Training Privacy Policy. Health information supplied for fitness services will be handled with reasonable care but may not be governed by HIPAA unless the specific circumstances legally require it.
Payment-card information is processed by third-party payment providers. Lynchpin Training does not directly control those providers’ systems or privacy practices.
Communications
Clients consent to receive transactional communications concerning purchases, appointments, forms, account activity, and service changes.
Marketing email or text messages will be sent only as permitted by law. Clients may opt out of marketing communications without affecting necessary transactional messages.
Electronic Agreements
Electronic acceptance, online checkout, and electronic signatures have the same effect as accepting or signing an agreement in paper form to the extent permitted by law.
Clients should retain copies of their order confirmation, policies, waivers, and services agreement.
Changes to Services or Terms
Lynchpin Training may make prospective changes to services, schedules, prices, or these Terms.
Material changes affecting an existing package will not reduce a client’s mandatory legal rights. The version accepted at purchase will ordinarily govern that transaction unless the parties agree otherwise or applicable law requires a different result.
Governing Law
These Terms are governed by the laws of the State of California, without limiting any consumer protection that applies to the client.
Before filing a legal claim, the parties are encouraged to communicate in good faith and attempt an informal resolution. This provision does not prevent either party from exercising a legal right or seeking relief from an appropriate court or agency.
Severability
If any provision is found unlawful or unenforceable, it will be enforced to the greatest extent legally permitted, and the remaining provisions will remain effective.
Entire Agreement
These Terms, the Refund and Cancellation Policy, Privacy Policy, applicable order details, waiver, PAR-Q, and any signed client services agreement constitute the agreement relating to the purchased services.
