California Cancellation Rights
Nothing in this policy limits any cancellation or refund rights provided by applicable law.
When California’s Health Studio Services Contract Law applies, a client may have the right to cancel within the period required by law. The applicable cancellation period may vary based on the total contract price.
Clients may also have additional cancellation rights in circumstances involving disability, death, relocation more than 25 miles from the studio, material reduction of services, studio closure, or other circumstances specified by law.
To exercise a statutory cancellation right, the client must provide a signed and dated cancellation notice or another legally permitted notice clearly stating the intention to cancel. Notice may be delivered or mailed to the studio address above. Lynchpin Training also accepts cancellation requests by email at danny@lynchpinfit.com.
Any refund required by law will be issued within the legally required period, less the reasonable value of services already received when permitted by law.
Evaluation and Consultation Appointments
The initial comprehensive fitness evaluation and any consultation are reserved appointments.
A client may cancel or reschedule an evaluation or consultation without penalty by providing at least 24 hours’ notice.
If fewer than 24 hours’ notice is provided, or the client does not attend the appointment, the appointment fee may be forfeited, except when prohibited by law or when Lynchpin Training approves an exception for an emergency or other extraordinary circumstance.
Training Sessions and Packages
Subject to applicable law:
- Completed sessions are nonrefundable.
- Session packages are nontransferable and may be used only by the client for whom they were purchased.
- A client who cancels or reschedules a session with at least 24 hours’ notice will retain the session credit.
- A cancellation made fewer than 24 hours before the appointment may be counted as a used session.
- Failure to attend an appointment without notice may be counted as a used session.
- Lynchpin Training may make reasonable exceptions for emergencies at its discretion.
- Unused sessions expire 12 months after the purchase date unless a different written expiration date is provided or applicable law requires otherwise.
Package Refunds After the Applicable Cancellation Period
Once any legally required cancellation period has expired, session packages are generally nonrefundable except:
- When a refund is required by law;
- When Lynchpin Training permanently discontinues the purchased service and cannot provide a reasonable substitute;
- When a documented medical condition or disability prevents the client from continuing;
- When the client relocates and qualifies for cancellation under applicable law; or
- When Lynchpin Training approves an exception in writing.
If a discretionary refund is approved after one or more sessions have been used, the refund may be calculated by subtracting:
- The regular single-session price for each session used;
- Any applicable, lawful cancellation or administrative charge; and
- Any other nonrefundable services already delivered.
The remaining eligible balance will be refunded to the original payment method whenever reasonably possible.
Group Sessions
A group-session reservation may be cancelled or rescheduled with at least 24 hours’ notice, subject to availability.
Cancellations made fewer than 24 hours before class and failure to attend may result in forfeiture of that session credit because space is limited.
Studio Cancellations
If Lynchpin Training cancels an appointment, the client may choose to:
- Reschedule without losing the session credit;
- Receive an account credit; or
- Receive a refund for that individual session if a reasonable replacement appointment cannot be arranged.
Temporary closures, instructor illness, emergencies, unsafe conditions, or events beyond Lynchpin Training’s reasonable control may require appointments to be rescheduled.
Medical Circumstances
Clients should notify Lynchpin Training promptly if an injury, illness, pregnancy, disability, or physician’s instruction affects their ability to participate.
Lynchpin Training may request reasonable documentation when considering a medical cancellation, extension, or prorated refund. Any legally required disability-related cancellation or refund will be honored.
Refund Processing
Approved refunds will generally be submitted to the original payment method within 10 business days. The client’s bank or card issuer may require additional time to post the credit.
Payment-processing charges will be handled in accordance with applicable law and the payment processor’s rules.
Chargebacks and Payment Disputes
Clients are encouraged to contact Lynchpin Training before initiating a chargeback so that billing errors or service concerns can be investigated promptly.
This provision does not waive or restrict any lawful right to dispute an unauthorized or incorrect charge.
Policy Changes
Lynchpin Training may revise this policy prospectively. The policy in effect on the date of purchase will ordinarily govern that purchase, except where a change is required by law or is more favorable to the client.
